01Your Page. Your Words.

Dear Humanity does not require your contribution to be:

• positive;
• inspirational;
• optimistic;
• polite;
• popular;
• politically neutral;
• socially acceptable;
• agreeable;
• conventional; or
• consistent with the views of Dear Humanity.

Participants may express beliefs, opinions, experiences, criticism, humour, grief, anger, hope, disagreement, personal reflections and other forms of lawful human expression.

Dear Humanity does not remove or restrict content merely because it may offend, upset, challenge or provoke another person.

02Participant Responsibility

You are responsible for the content you submit.

Before submitting content, you should consider carefully:

• what you want to say;
• what image you want associated with your Page;
• whether you have the right to submit that image or material;
• whether your content contains information about another person;
• whether your content could violate another person's rights; and
• whether you are willing for your final sealed Page to ultimately become public.

You should not submit content you do not have the legal right to provide.

03Content Does Not Represent Dear Humanity

Participant Content represents the views and choices of the participant who submitted it.

Dear Humanity's decision to host, preserve, publish, display, reproduce, distribute, license or otherwise use Participant Content does not mean Dear Humanity:

• agrees with it;
• endorses it;
• supports it;
• verifies it;
• adopts it;
• considers it accurate; or
• considers it morally or socially acceptable.

The purpose of Dear Humanity is to preserve human expression, not to make every participant speak with one approved voice.

04Controversial or Offensive Content

Content is not prohibited merely because another person considers it:

• offensive;
• insulting;
• disturbing;
• controversial;
• provocative;
• politically unpopular;
• religiously unpopular;
• socially unpopular;
• pessimistic;
• angry;
• confronting;
• critical;
• unusual; or
• disagreeable.

Dear Humanity may allow content that many people strongly disagree with.

Disagreement alone is not a reason for removal.

However, freedom of expression within Dear Humanity remains subject to the boundaries set out in this Content Policy and applicable law.

05Illegal Content

You must not submit content that is unlawful to possess, publish, distribute, communicate or otherwise make available.

Dear Humanity may restrict, remove, preserve, withhold or report content where reasonably necessary to comply with applicable law.

06Child Sexual Abuse or Exploitation Material

Dear Humanity strictly prohibits content involving the sexual abuse, exploitation or unlawful sexualisation of children.

This includes content that:

• depicts child sexual abuse;
• facilitates child sexual exploitation;
• solicits sexual material involving a child;
• sexualises a child unlawfully;
• promotes or encourages child sexual exploitation; or
• is otherwise unlawful material involving the sexual exploitation of minors.

Dear Humanity may remove, preserve and report such material to relevant authorities or organisations where required or permitted by law.

07Non-Consensual Intimate Content

You must not submit intimate or sexual imagery of another person where you do not have the lawful right and required consent to provide it.

This includes non-consensual intimate imagery, voyeuristic material and other intimate content unlawfully shared without permission.

08Threats and Serious Violence

You must not submit credible threats of violence against another person or identifiable group.

You must not use Dear Humanity to communicate a genuine intention to seriously harm another person.

Content discussing violence, war, crime, death or violent experiences is not automatically prohibited.

The relevant distinction is between discussing or expressing views about violence and making a credible or unlawful threat.

09Serious Criminal Activity

You must not use Dear Humanity to unlawfully facilitate, organise, instruct, encourage or materially assist serious criminal activity.

Content discussing crime, criminal justice, historical crimes, personal experiences, political issues or controversial laws is not automatically prohibited.

10Terrorism and Violent Extremism

You must not submit content where its publication, possession or distribution would be unlawful because it promotes, instructs, facilitates or supports terrorist or violent extremist activity.

Dear Humanity may restrict or report content where required by applicable law.

Discussion, criticism, reporting, historical analysis or personal commentary concerning terrorism or extremism is not automatically prohibited.

11Personal Information and Doxxing

You must not unlawfully publish highly sensitive or private information about another person.

This may include, depending on the circumstances:

• private residential addresses;
• private telephone numbers;
• private financial information;
• account credentials;
• government identification numbers;
• private medical information;
• private sexual information;
• passwords;
• authentication information; or
• other information disclosed for the purpose of exposing, threatening or seriously harming another person.

Mentioning another person, discussing experiences involving other people or expressing opinions about public figures is not automatically prohibited.

12Defamatory or Unlawful Statements

You are responsible for statements you make about other people.

Dear Humanity does not verify the truth of every participant statement before publication.

You must not knowingly use the Service to publish unlawful false statements about another person.

Dear Humanity may investigate or restrict content where a credible legal complaint is received.

The existence of a complaint does not automatically mean content will be removed.

13Harassment and Targeted Abuse

Dear Humanity is not intended to be used as a tool for sustained harassment, intimidation or targeted abuse.

Strong criticism, disagreement, offensive opinions and personal commentary are not automatically prohibited.

However, Dear Humanity may act where content forms part of unlawful harassment, credible threats, serious privacy violations or other unlawful conduct.

14Intellectual Property

You must have the rights, permissions, licences and consents necessary to submit the content you provide.

You must not knowingly submit material that unlawfully infringes another person's:

• copyright;
• trade mark;
• design rights;
• confidential information; or
• other intellectual property rights.

This is especially important for images, artwork, photography and other creative works.

If you did not create an image yourself, you should ensure you have the legal right to use it.

15Images of Other People

Your Page image does not have to be a photograph of you.

It may depict other people.

Where another identifiable person appears in your image, you are responsible for ensuring you have any consent, permission or other legal authority required to submit and permit use of that image.

Additional care should be taken where children appear in submitted images.

16Impersonation

You must not use Dear Humanity to fraudulently impersonate another person.

You must not create an account or Page pretending to be another person without lawful authority.

Parody, satire, fictional writing or commentary is not automatically prohibited where it does not unlawfully mislead people about the identity of the participant.

17Fraud and Deception

You must not use Dear Humanity for fraud or deliberate unlawful deception.

This includes using the Service to:

• obtain money through fraudulent representations;
• impersonate another person for dishonest purposes;
• manipulate participation through fraudulent accounts;
• circumvent the one-person, one-Page rule through deception; or
• materially interfere with the integrity of Volume I.

18Malware and Technical Abuse

You must not submit or attempt to submit:

• malware;
• malicious code;
• viruses;
• spyware;
• executable attacks;
• harmful scripts;
• code intended to compromise the Service; or
• other material designed to interfere with systems, accounts or users.

19Legal Orders and Restrictions

Content must not violate a binding court order, tribunal order, regulatory direction or other legal restriction applicable to the participant or Dear Humanity.

Dear Humanity may restrict access to content where reasonably necessary to comply with legal obligations.

20Legal Operator

For the purposes of this Content Policy, Dear Humanity is operated by Oakley Equity Holdings Pty Ltd, ABN 39 691 699 11, trading and operating the Service under the Dear Humanity brand.

References in this Content Policy to "Dear Humanity", "we", "us" or "our" refer to the operator of the Service in that capacity.

21Moderation

Dear Humanity may review Participant Content where reasonably necessary.

Moderation may occur:

• before sealing;
• after sealing;
• before publication;
• after publication;
• following a complaint;
• following a legal request;
• following automated detection;
• following a safety concern; or
• where Dear Humanity otherwise reasonably determines review is necessary.

Dear Humanity is not required to manually review every submission before it is sealed or published.

22Automated Content Review

Dear Humanity may use automated or semi-automated systems to help identify content that may violate this Content Policy or applicable law.

Automated systems may be used to detect matters including:

• child exploitation material;
• malware;
• suspicious files;
• duplicate content;
• fraud;
• security threats;
• potentially unlawful imagery; and
• other high-risk content.

Automated detection does not necessarily mean content will automatically be removed.

Where appropriate, Dear Humanity may conduct additional review.

23Sealed Pages May Still Be Reviewed

Sealing a Page does not prevent Dear Humanity from reviewing it.

A sealed Page may still be accessed or reviewed for purposes including:

• legal compliance;
• content moderation;
• safety;
• fraud prevention;
• intellectual property complaints;
• security;
• technical support;
• responding to lawful requests;
• enforcing the Terms; and
• protecting Dear Humanity or other people.

"Sealed" means sealed from ordinary public access before Volume I opens. It does not mean inaccessible for moderation or legal purposes.

24Action We May Take

Where Dear Humanity reasonably determines that content violates this Content Policy, the Terms or applicable law, we may take action including:

• restricting the content;
• preventing sealing;
• withholding publication;
• disabling public access;
• removing content;
• preserving evidence;
• requesting further information;
• requesting proof of rights or permission;
• suspending an account;
• terminating an account;
• cancelling an invitation;
• reporting content or conduct where required or permitted by law; or
• taking other reasonable steps necessary to address the issue.

The action taken may depend on the seriousness, context and legal status of the content.

25Preservation of Content

Removing or restricting Participant Content does not necessarily mean every copy will immediately be deleted.

Dear Humanity may preserve content or related records where reasonably necessary for:

• legal compliance;
• law enforcement requests;
• investigations;
• safety;
• fraud prevention;
• security;
• dispute resolution;
• intellectual property claims;
• record keeping;
• backups;
• evidence; or
• enforcement of agreements.

26Reporting to Authorities

Dear Humanity may report Participant Content, account information or related activity to law enforcement, regulators, safety organisations or other appropriate bodies where required or permitted by law.

This may include circumstances involving:

• child sexual abuse or exploitation;
• credible threats;
• serious criminal activity;
• serious safety concerns;
• fraud;
• cybercrime; or
• other unlawful activity.

27Content That Becomes Unlawful

Laws may change after a participant submits or seals a Page.

Content that was lawful when submitted may later become subject to a legal restriction.

Dear Humanity may restrict, alter access to, preserve or remove content where necessary to comply with laws or legal obligations applying at that time.

28Different Laws in Different Countries

Dear Humanity may be accessible internationally.

Content permitted in one jurisdiction may be restricted in another.

Where reasonably necessary, Dear Humanity may:

• limit content in particular countries;
• restrict access based on location;
• comply with local legal orders;
• withhold content in particular jurisdictions; or
• take other steps required by applicable law.

A restriction applying in one jurisdiction does not necessarily mean the content will be removed globally.

29Content Complaints

A person who believes Participant Content violates this Content Policy, applicable law or their legal rights may contact Dear Humanity.

Complaints should contain enough information to identify:

• the relevant content;
• the nature of the concern;
• the person making the complaint;
• the legal or policy basis for the complaint where applicable; and
• any relevant supporting information.

Dear Humanity may request additional information before acting on a complaint.

30Intellectual Property Complaints

A person claiming that Participant Content infringes their intellectual property rights should provide sufficient information for Dear Humanity to understand and assess the claim.

This may include:

• identification of the protected work;
• identification of the allegedly infringing content;
• information demonstrating ownership or authority;
• contact information; and
• an explanation of the claimed infringement.

Dear Humanity may restrict content while a legitimate rights dispute is investigated.

31Privacy Complaints

If you believe Participant Content unlawfully reveals your personal information or violates your privacy rights, you may contact Dear Humanity.

Dear Humanity may consider factors including:

• the nature of the information;
• whether it was previously public;
• the context of the Page;
• the participant's rights;
• the complainant's rights;
• potential harm;
• public interest;
• applicable law; and
• the permanent publishing nature of Dear Humanity.

32No Guarantee That Content Will Remain Available

Although Dear Humanity is designed around permanence, no participant is guaranteed that their content will remain publicly available in all circumstances.

Content may be restricted or removed where necessary for:

• legal compliance;
• safety;
• privacy;
• infringement;
• fraud;
• security;
• court orders;
• regulatory requirements; or
• enforcement of Dear Humanity's policies.

33Removal Does Not Revoke Rights Already Granted

Where Participant Content is removed, restricted or withheld, any rights previously granted to Dear Humanity in that content remain governed by the Terms of Participation and Use.

Removal from public display does not itself revoke intellectual property rights, licences or other permissions already granted to Dear Humanity except where required by applicable law.

34Editorial and Technical Changes

Dear Humanity may make reasonable technical, production, formatting and editorial changes necessary to present Participant Content.

These may include:

• resizing;
• cropping;
• formatting;
• compression;
• colour conversion;
• layout adjustments;
• typography;
• file conversion;
• metadata processing;
• accessibility formatting; and
• other technical changes.

Dear Humanity does not intend to materially alter the meaning of a participant's final message merely to make it more agreeable or less controversial.

35Publication Context

Dear Humanity may display Participant Content alongside:

• Page numbers;
• standard Book text;
• names;
• editorial information;
• navigation;
• contextual information;
• other participant Pages;
• historical information;
• invitation relationships;
• design elements; and
• other features forming part of the Dear Humanity experience.

The appearance of content alongside another Page does not imply an association, endorsement or agreement between participants.

36Difference Between Moderation and Endorsement

A decision to leave content available does not mean Dear Humanity endorses it.

A decision to remove or restrict content does not necessarily mean Dear Humanity disagrees with it.

Moderation decisions may be based on legal, safety, privacy, intellectual property, security or platform-integrity considerations rather than the viewpoint expressed.

37No Political or Ideological Test

Dear Humanity does not require participants to adopt a particular political, religious, philosophical, cultural or ideological position in order to participate.

A political or ideological opinion is not prohibited merely because it is controversial or opposed by other participants.

Content remains subject to the same legal and safety boundaries that apply to all Participant Content.

38Historical and Cultural Context

Dear Humanity is intended to become a record of what people chose to say at a particular point in time.

As a result, Volume I may contain opinions, language, images or ideas that future audiences consider uncomfortable, outdated, controversial or offensive.

The existence of such material may itself form part of the historical record created by the project.

Dear Humanity may preserve lawful content for this reason even where public attitudes later change.

39Participants Are Not Required to Be Identical

Dear Humanity is not intended to produce one unified message.

Participants may contradict one another.

One Page may express a belief that another Page rejects.

Dear Humanity considers this diversity of lawful expression part of the nature of the project.

40Changes to This Content Policy

Dear Humanity may update this Content Policy where reasonably necessary to reflect:

• changes in law;
• regulatory requirements;
• safety requirements;
• new types of Participant Content;
• changes in technology;
• changes in Dear Humanity's products or publication methods;
• emerging forms of abuse; or
• legitimate operational requirements.

The current version may be published through the Dear Humanity website with an updated "Last updated" date.

Where required by applicable law, additional notice of material changes may be provided.

41Relationship With Other Policies

This Content Policy should be read together with the Dear Humanity Terms of Participation and Use and Privacy Policy.

The Terms of Participation and Use govern matters including:

• participation;
• intellectual property rights;
• licences;
• commercial use of Participant Content;
• payments;
• invitations;
• sealing Pages;
• publication;
• account restrictions; and
• participant responsibilities.

The Privacy Policy explains how personal information is collected, used, stored and disclosed.
